If you reside in the United States and your Private Information was accessed and/or acquired as a result of a business email compromise that targeted one Twin Cities Pain Clinic's (“TCPC”) employee email account in July 2025 (the “Data Incident”), then you may be a Class Member. Excluded from the Settlement Class are: (1) TCPC and its officers, directors, and related companies; (2) governmental entities; (3) the Judge in this case, and the Judge’s family and staff; and (4) anyone who validly excludes themselves from the Settlement.

If you are a Settlement Class Member and wish to receive Settlement Benefits then you must submit a Claim Form by November 9, 2026.

TCPC has agreed to pay for a number of benefits, which are explained below. All Class Members may claim two years of Credit Monitoring through CyEx Financial Shield Complete, and one of two Cash Payment options.

There is an aggregate cap of $385,000.00 on Cash Payment benefits. This means that if the total value of Cash Payments claimed is over $385,000.00, everyone’s payments will be reduced pro rata so that they add up to $385,000.00. Credit Monitoring. All Class Members are eligible to enroll in two (2) years of CyEx Financial Shield Complete. This comprehensive service comes with $1 million of financial fraud insurance, and includes monitoring for:

  • fraud and identity theft

  • unauthorized financial transactions

  • personal information associated with high-risk transactions

If anything suspicious happens, you will be able to talk to a fraud resolution agent to help fix any problems.

Cash Payment A - Documented Losses. Class Members who incurred actual, documented out-of-pocket losses due to the Data Incident, can get back up to $4,500.00 for extraordinary losses (losses due to identity theft or fraud), or up to $450.00 for ordinary losses (out-of-pocket expenses). The losses must have occurred between July 9, 2025, and November 9, 2026, and you cannot claim a payment for expenses that have already been reimbursed by a third party. This benefit covers out-of-pocket expenses like:

  • losses because of identity theft or fraud (extraordinary expenses)

  • fees for credit reports, credit monitoring (only to the extent the purchased service exceeded the complimentary credit monitoring offered in features or scope), or freezing and unfreezing your credit

  • cost to replace your IDs

  • postage to contact banks by mail

You need to submit proof, like bank statements or receipts, to show how much you spent or lost. You can also provide notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim. Your proof or notes should show that your expenses were because of the Data Incident.

Cash Payment B - Flat Cash. Instead of a payment for Cash Payment A - Documented Losses, Class Members may claim a one-time cash payment. This payment is expected to be $55.00.

The deadline to submit a Claim Form online or by email is November 9, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than November 9, 2026.
